SCRIPT:

A CINCINNATI MAN HAS BEEN CONVICTED OF MURDER AND FELONIOUS ASSAULT, BASED ON THE VICTIM'S OWN IDENTIFICATION OF THE SUSPECT.

DAVID CHANDLER WAS SHOT IN THE HEAD AND NECK IN OCTOBER, 20-10, LEAVING HIM PARALYZED AND ON A VENTILATOR.

TWO WEEKS BEFORE CHANDLER DIED, POLICE QUESTIONED HIM, ASKING HIM TO BLINK THREE TIMES FOR YES, TWICE FOR NO.

POLICE SOMETIMES HAD TO REPEAT QUESTIONS WHEN CHANDLER FAILED TO RESPOND.

HOWEVER, THE VIDEO SHOWED CHANDLER BLINKING HIS EYES HARD THREE TIMES WHEN POLICE SHOWED HIM RICARDO WOODS' PICTURE, AND ASKED IF WOODS WAS THE SHOOTER.

HE REPEATED THE BLINKS WHEN ASKED IF HE WAS SURE.

THE DEFENSE HAD TRIED TO BLOCK THE VIDEO FROM COURT, SAYING CHANDLER'S RESPONSES WERE INCONSISTENT AND UNRELIABLE.

WOODS COULD GET LIFE IN PRISON WHEN HE'S SENTENCED NEXT MONTH.

THE DEFENSE SAYS IT WILL APPEAL.

TIM MAGUIRE, THE ASSOCIATED PRESS.
