A property damage claim brought by a serial rapist involved in a riot at the Port Augusta prison has been dismissed by South Australia's District Court.

Trevor John Brooks is serving a 27 year sentence for stalking, home invasion and several rapes.

Brooks lodged a compensation claim for loss of personal belongings after prisoners rioted at the Port Augusta facility in 2008.

Corrections officers seized and destroyed prisoners' personal property from a ward that was exposed to asbestos.

Brooks was suing the state for $1,100.

The state had mounted a counter claim, saying the riot left a damage bill of more than $1 million.

Lawyers have now argued Brooks had no standing to bring the claim because he was declared bankrupt.

The court dismissed the claim and the Crown indicated it would discontinue the counter-claim.
