Cancer group loses gene patent case

A cancer group which fought against the patenting of a human gene linked to breast and ovarian cancer has lost its landmark case in the Federal Court.

In a judgment handed down in Sydney on Friday, Justice John Nicholas found against Brisbane woman Yvonne D'Arcy and Cancer Voices Australia.

They had taken the case against Myriad Genetics Inc, the owner of the patent, and Melbourne-based Genetic Technologies Ltd, which holds the exclusive licence to conduct the tests in Australia.
