A Magistrate has refused to grant bail to an Albany man accused of trying to organise a murder.

Brian Vincent Atwell, 73, is alleged to have paid $10,000 to a man in September last year, to kill a witness whose identity is suppressed.

The Stirling Gardens Magistrates Court in Perth has been told the man Atwell spoke to turned out to be an undercover police officer.

Atwell's lawyer argued her client intended to plead not guilty to the charge and should be released on bail, largely because of his age and ill health.

The Magistrate said the alleged offence was serious and Atwell should remain in custody.
