Crown fumbles in Patel prosecution

A legal wrangle is yet to be resolved ahead of the Brisbane trial of former Bundaberg surgeon Jayant Patel.

Patel is due to face trial in the Supreme Court next month accused of manslaughter.

The allegation relates to an operation he performed on 75-year-old Mervyn Morris in 2003.

As part of the prosecution process, lawyers for the Crown must particularise in detail what it is they allege Patel did and how they will prove his guilt.

They have already had four attempts.

Patel's lawyers have again applied to have the particulars struck out, arguing prosecutors have not done enough to spell out how Patel caused the death.

Supreme Court Justice George Fryberg has reserved his decision.
